Well, if 99designs would work like an escrow then that might justify the additional cost of launching a contest on the site. Otherwise, there would be no real added value in merely providing a communication interface. Email would suffice. That's just my two cents. Would like to see others' comments as well.
99designs might not be happy with "invitation only contests" as they want everyone to be able to see how the site works. However, as Nadia said, there is considerable number of CHs who are worried about their privacy, as well as designers who are worried about concept copying.
99designs may charge CHs more than 39 credits to start an invitation only contest and request that payment is guaranteed.
I would be more interested and thrilled by private contests where contest holders can restrict the view and participation to only "invited" designers. We work in highly competitive markets where Einstein's mantra "Creativity is knowing how to hide your resources" is the ultimate business survival rule.
This feature is now up and running. Why is it still marked as "planned"?

99designs is about design and should remain so, IMHO. I suggest that a section coding be opened in the marketplace, not 99designs itself.
